„Content” means software, services, materials and other data that we own, are authorized to use, may distribute or sublicense and that we send to or download from the Wii Console or Wii Network Service. You are responsible for all purchases, downloads or other purchases of content made through your network account in the Nintendo eShop. Nintendo online purchases are non-refundable and non-transferable unless the terms published for a given offer do not specify anything else or are prescribed by law. Digital Content is permitted, not sold by the Content Provider solely for your personal, non-commercial use on your Nintendo device or as permitted by us through the Network Services, subject to the terms of this Agreement and any additional terms that will be posted in the Nintendo eShop for the digital content in this article, and subject to your full payment for such digital content. Digital content licenses purchased through your Nintendo Account and downloaded to a Nintendo device can be viewed and used through other Nintendo Accounts on that Nintendo device. We may change the terms of this agreement, the Wii Code of Conduct or the Wii Privacy Policy at any time. An updated version of this agreement will be available on the Internet under support.nintendo.com. If you do not have access to the Internet, you can contact our after-sales service and we will send you an updated version of this agreement free of charge. We will post a notice on support.nintendo.com if the agreement is changed at least 5 days before the progress of the changes. If you do not agree with these changes, you must terminate your Wii Network Service in accordance with this Agreement. If you do not have access to the Internet, you should contact our after-sales service regularly to find out if the agreement has changed since the last version you received. A detailed description of the Nintendo DSi`s wireless communication features and parental controls can be found in the Nintendo DSi Operations Manual, which is attached to your Nintendo DSi and is also available in support.nintendo.com. Subject to the terms of this Agreement, you may use the software, content and data that was included in the Console or that is compatible or permitted with its connection, including any updates or replacements to such software, content or data that we or our authorized suppliers provide to you (together the „Software”).
The software is not sold to you solely for your personal, non-commercial use on the console. You must not publish, copy, modify, reinsert, rent, decompile, decompile, disassemble, distribute, sell or create derivative works of the Console, or circumvent, modify, modify, modify, undo, manipulate or circumvent any features or protective measures of the Console, except as permitted by law. Content received through the use of an unauthorized device or through unauthorized modification of console hardware or software may be removed. You agree not to use the Console unlawfully or to access the consoles, devices, accounts or data of other consoles (including Nintendo) without (or ours`) consent. We are committed to protecting the privacy and security of your personal data. Your use of Nintendo DSi is subject to the Nintendo DSi Privacy Policy, which applies to information transmitted or collected through the Nintendo DSi Service. The latest version of the Nintendo DSi Privacy Policy, which we may revise from time to time, is published in support.nintendo.com. You can also contact our division, and we will send you the current version for free.
We own all right, title and interest in the Wii Network Service and Nintendo IP, or we have the right to distribute, use or sublicense it.
